Gazosa La Fiorenzana | Terms and Conditions of Service for our Online Shop
We want your relationship with Gazosa La Fiorenzana to be clear and straightforward from your very first order. On this page you'll find the general terms and conditions governing the use of our online shop, written as simply and clearly as possible, because we believe transparency is the foundation of every good relationship.
The original language of this policy is Italian. The English version is provided solely for ease of understanding and has no legal value. In the event of any contradictions or ambiguities, the original Italian text shall prevail.

SECTION 1 | GENERAL PROVISIONS
Art. 1.1 TCS | Scope
These Terms and Conditions of Service (hereinafter «TCS») apply to all orders placed through the Gazosa La Fiorenzana online shop, operated by Ponzio – Tonna SA, Via Cantonale 52, CH-6537 Grono.
Art. 1.2 TCS | Acceptance of Terms
By submitting an order, the Customer declares to have read, understood and fully accepted these TCS and all related policies available on the online shop. The TCS in force at the time of the order are binding for the contractual relationship. Conditions of the customer that deviate from these TCS will not be recognised.
Art. 1.3 TCS | Changes to the TCS
We reserve the right to modify these TCS at any time. The version in force at the time of the order is binding for the concluded contract. Changes have no retroactive effect.
Art. 1.4 TCS | Customers
The offer of the Gazosa La Fiorenzana online shop is directed exclusively at customers residing in Switzerland. Deliveries are limited to this territory.
Art. 1.5 TCS | Age Restriction
For products subject to age restrictions (in particular alcoholic beverages), the customer confirms by placing the order that they meet the legal age requirement. We reserve the right to cancel orders in case of doubt.
SECTION 2 | PRODUCTS AND PRICES
Art. 2.1 TCS | Product Information
Product images published on the online shop are illustrative and may differ slightly from the actual product. We strive to provide accurate and up-to-date descriptions, but if you have any doubts about a specific product, just contact us!
Art. 2.2 TCS | Prices
All prices published on the online shop are final prices in Swiss francs (CHF) and include VAT. Shipping costs, where applicable, are shown separately during the checkout process.
Art. 2.3 TCS | Price Changes
We reserve the right to change prices at any time. The price shown at the time the contract is concluded is binding.
Art. 2.4 TCS | Availability
We strive to keep product availability information up to date. However, in exceptional cases, a product may not be available after order confirmation. In that case we will contact you promptly to find the best solution together.
Art. 2.5 TCS | Quantities
We reserve the right to decline orders that exceed a reasonable quantity for personal or family use, without having to provide specific reasons.
SECTION 3 | CONTRACT CONCLUSION
Art. 3.1 TCS | Offer and Acceptance
The products and prices published on the online shop constitute a sales offer. The contract is concluded when the customer places the order online and receives the automatic confirmation by email. We reserve the right, however, to refuse an order within 2 working days of receipt, in particular in the event of pricing errors, out-of-stock items or incomplete customer data.
Art. 3.2 TCS | Order Confirmation
As soon as your order is received, we send you a confirmation by email to the address provided. This confirmation acknowledges receipt of the order but does not guarantee product availability, we will notify you immediately in case of any issues.
Art. 3.3 TCS | Pricing Errors
In the event of an obvious error in a published price, we reserve the right to cancel the order and fully refund the customer. We will contact you immediately to explain the situation.
SECTION 4 | PAYMENT
Art. 4.1 TCS | Payment Methods
The available payment methods are shown during the checkout process. Payments must be made in Swiss francs.
Art. 4.2 TCS | Advance Payment by Bank Transfer
In the case of payment by bank transfer, shipment will only take place after receipt of payment. Products are reserved for a maximum of 5 working days pending the credit. If payment is not received within this period, the order may be cancelled.
Art. 4.3 TCS | Retention of Title
Products remain the property of Gazosa La Fiorenzana until full payment of the order has been received.
Art. 4.4 TCS | Late Payment
In the event of non-payment within the agreed terms, we reserve the right to suspend further orders and initiate debt recovery proceedings. Any related costs are at the customer's expense.
SECTION 5 | DELIVERY
Art. 5.1 TCS | Delivery Area
We deliver exclusively within Swiss territory. For full details on methods, costs and delivery times, please refer to our Shipping Policy (ISS).
Art. 5.2 TCS | Delivery Times
Delivery times indicated on the shop are purely indicative. In the event of unforeseen delays, we will contact you promptly. If the delay exceeds 30 calendar days from the expected delivery date, the customer has the right to withdraw from the contract and receive a full refund.
Art. 5.3 TCS | Risk Transfer
The risk of loss or damage to the goods passes to the customer at the moment the shipment is handed over to Swiss Post.
Art. 5.4 TCS | Inspection Obligation
Check your order as soon as it arrives! Any damage, shortages or discrepancies must be reported within 5 days of receipt. Late reports may not be accepted.
SECTION 6 | RIGHT OF WITHDRAWAL AND RETURNS
Art. 6.1 TCS | Right of Withdrawal
The customer has the right to withdraw from the contract within 14 days of receiving the goods, without having to provide reasons. For full details on methods and conditions, please refer to our Returns and Refunds Policy (IRR).
SECTION 7 | WARRANTY
Art. 7.1 TCS | Legal Warranty
Gazosa La Fiorenzana warrants its products in accordance with applicable Swiss law. In the event of a defective product, we will arrange a replacement or refund in accordance with the procedures described in our Returns and Refunds Policy (IRR).
Art. 7.2 TCS | Exclusions
The warranty does not cover damage caused by improper use, tampering, or external events not attributable to Gazosa La Fiorenzana.
SECTION 8 | LIABILITY
Art. 8.1 TCS | Limitation of Liability
Gazosa La Fiorenzana assumes no liability for indirect or consequential damages arising from the use of purchased products, except in cases provided for by Swiss law.
Art. 8.2 TCS | Force Majeure
We are not liable for delays or non-deliveries caused by force majeure events: bad weather, strikes, pandemics or other events beyond our control. In such cases we will contact you as soon as possible to find a solution together.
Art. 8.3 TCS | Account Security
The customer is responsible for keeping their login credentials for the online shop confidential. All actions carried out through their account are attributed to the customer.
SECTION 9 | ORDER MODIFICATION AND CANCELLATION
Art. 9.1 TCS | Order Modification
Confirmed orders are binding. To request a change, contact us as soon as possible, we'll do our best to accommodate you, but we cannot guarantee modifications once an order is being prepared.
Art. 9.2 TCS | Cancellation by the Customer
In the event of cancellation by the customer after confirmation, we reserve the right to retain a portion to cover administrative costs incurred. The customer will be informed before any charge is made.
Art. 9.3 TCS | Cancellation by Us
In the event of total or partial inability to deliver, the customer will be promptly notified by email and fully refunded for any amounts already paid.

All content on this website: texts, images, logos, graphics, videos and any other material is the exclusive property of Ponzio – Tonna SA, owner of the Gazosa La Fiorenzana brand, or the respective rights holders. All rights reserved.

The name Gazosa La Fiorenzana, its logo and all associated distinctive signs are registered trademarks of Ponzio – Tonna SA. Any unauthorised use is expressly prohibited and punishable under applicable Swiss law.
